1. ACCESS TO AND OPERATION OF THE WEBSITE
The Legal Notice and Terms of Use regulate Users' access to and use of the Website, the purpose of which is to provide users with the opportunity to request visits to the establishment, book long-stay temporary rentals for students, and contract such stays on this website.
2. USING THE WEBSITE
The User agrees to make appropriate use of the contents of the Website and undertakes the following:
- Provide truthful and accurate information about the data requested on the various forms, and update them every time they use the Website.
- Not to engage in activities that are illicit, illegal or contrary to good faith and public order.
- Not to disseminate content or propaganda of a racist, xenophobic, discriminatory nature due to race, sex, ideology, religion or that in any way violates morality, public order, fundamental rights, public freedoms, honour, privacy or the reputation of third parties and, in general, current laws.
- Not to cause damage to the physical and logical systems of the Website, of Greystar suppliers, or of third parties, nor to introduce or spread any computer viruses in the network or any other physical or logic systems that may cause the aforementioned damage.
- Not to use the contents of the Website and the information on it to send advertising, or send messages for any other commercial purpose, or collect or store personal data from third parties.
- Not to attempt to access and use other users' email accounts and modify or tamper with their messages.
- Greystar reserves the right to make, without prior notice, any changes it deems appropriate to its Website, and may change, delete or add content and the services provided through it, including how they are presented or located on the Website. 3. LIABILITIES
a) Liabilities relating to the use of the Website: The User is solely liable for any infringements that the User may commit or damages that the User may cause when using the Website, and Greystar is hereby released from any liability that may arise from the User's actions.
Greystar will make every reasonable effort and use all reasonable means to provide up-to-date and reliable information on the Website. However, Greystar does not offer any guarantee regarding the presence of errors or possible inaccuracies and/or omissions in any of the contents accessible through this Website.
The User is solely liable for any claim or legal, judicial or extrajudicial action brought by third parties against Greystar based on the use of the Website by the User. Where applicable, the User shall bear all expenses, costs and indemnities incurred by Greystar as a result of such claims or lawsuits.
b) Liability relating to the operation of the website: Greystar declines all liability that may arise from interferences, omissions, interruptions, computer viruses, telephone breakdowns or disconnections in the operation of electronic systems.
It also declines any liability that may arise from delays or blockages in the operation of this electronic system caused by deficiencies or overloading of telephone lines or the Internet, as well as damage caused by third parties through unauthorised interference beyond the control of Greystar. Greystar shall be entitled to suspend temporarily, and without prior notice, access to the Website for maintenance, repair, updating or improvement operations.
c) Liability relating to the content: Greystar shall not be held liable, except to the extent required by law, for any damage or harm that may be caused by the use, reproduction, distribution or public communication or any type of activity carried out on the texts and/or photographs that are protected by intellectual property rights belonging to third parties if Users of the site have not previously obtained the necessary authorisation from the owners for the use that they are making or intend to make of them.
Furthermore, Greystar shall not be held liable for any information sent by the User when it does not have effective knowledge that the information stored is illicit or that it harms third-party property or rights that could be subject to compensation. As soon as Greystar becomes aware that it is hosting data of the type mentioned above, it undertakes to act diligently to remove or prevent access to such data.

INFORMATION ON THE BOOKING PROCESS
1.1. Assessment of Applications
By submitting your booking application, you grant us your express consent to use the data provided by you to perform searches of sanctions lists maintained by the governments of France, Spain, the United Kingdom, the United States and other countries of our choice, including those operated by the Treasury. This will not affect your rights or our obligations to you under Organic Law 3/2018 on Data Protection and Guarantee of Digital Rights. You are entitled to ask us not to carry out such searches, but in doing so, we will not be able to proceed with your application.
As part of your application, you will be required to provide the following information:
i. Details of a guarantor and emergency contact.
ii. Identification information of the resident.
iii. Proof of student status/University registration.
iv. Employer contact details, if applicable.
v. Booking Fee [registration] and First Rental Payment.
vi. For bookings made before 31 July, the booking fee must be paid at the time of booking.
vii. For bookings made after 31 July, the first rental payment is due at the time of booking.
1.2. Card Payments
We use Stripe to process and collect transaction information.
1.3. Rental Contract
The Rental Agreement will only come into effect, and your right to occupy the room will commence, once:
(a) We have received the first rental payment and the guarantee deposit.
(b) The rental contract has been accepted and signed by all tenants and the guarantor, as well as by the Owner on the specified effective date.
Once you have signed the contract with Canvas®, you will be bound by its terms, which are governed and regulated under Spanish law. You may cancel your Rental Agreement subject to the Cancellation Policy described below. You will have the chance to read the terms that apply before agreeing to them. If you do not understand the terms, we recommend that you seek advice before agreeing to them.
1.4. Conditions for formalising the rental contract
To secure their accommodation, Residents must complete the following requirements within three (3) days of receiving the rental contract (the “Decision Period”):
(i) The tenant and, where applicable, the guarantor must sign the rental contract.
(ii) Pay the first month's rent and the guarantee deposit.
Failure to comply with these conditions by the specified deadline may result in the automatic cancellation of the reservation. If, at the end of the Decision Period, the contract has not been signed and the required payments have not been made, the offer will be void and the room will become available to other people.
1.5. Guarantee Deposit
The purpose of the guarantee deposit is to secure the accommodation reservation and to cover any repair costs that may arise from damage to the facilities or materials of the accommodation or the Residence, as well as to ensure compliance with the Resident's obligations.
The deposit will be refunded, if applicable, within two (2) months of departure from the residence, after deducting any outstanding amounts or attributable damages. In any case, the Owner shall be entitled to retain all or part of said amount to cover said costs and expenses.
1.6. Cancellation and guarantee deposit refund policy
Outside the Decision Period, Residents may cancel their reservation before the start date of the lease only in the following cases, provided that they notify the Property in writing and provide the corresponding supporting documentation within ten (10) calendar days of the date on which they received official notification confirming the alleged circumstance:
(a) Refusal of admission to a university or educational institution.
(b) Denial of a visa to enter Spain.
(c) Failure to pass academic requirements (EvAU/High School Diploma).
(d) Serious personal reasons, unforeseeable and beyond the control of the Resident, accredited by means of an official certificate.
In these cases, the cancellation request will be accepted and the Resident will be entitled to a full refund of the guarantee deposit, the first month's paid rent and, where applicable, the registration fee.
If cancellation is requested outside the Decision Period and after the effective date of the contract, Residents must provide the Owner with at least ten (10) days' notice. In such cases, neither the guarantee deposit nor the registration fee will be refunded.
The following circumstances, among others, shall be considered to fall within this category:
(a) Voluntary cancellation of the reservation after acceptance of the contract.
(b) Failure to comply with the deadlines regarding notification of refusal of admission or visa.
(c) Voluntary and unjustified early departure.
(d) Expulsion for serious breach of residence regulations.
(e) Outstanding debts exceeding the deposit.
(f) Any other cause not covered under reimbursable circumstances.
In such cases, the contract shall be deemed to have been unilaterally terminated by the Resident, and the Owner shall be entitled to retain the deposit as partial compensation for the damages caused.
Notwithstanding the foregoing, when the cancellation arises from any of the above circumstances but occurs sufficiently in advance, the following rules shall apply: if the cancellation takes place up to and including 15 June, the deposit shall be reimbursed in full, retaining only the registration fee, if applicable; if the cancellation occurs between 16 June and 30 July (both inclusive), fifty per cent of the deposit will be reimbursed, and the Owner shall retain the remaining fifty per cent and the registration fee; and, finally, when the cancellation is made on or after 31 July, no reimbursement shall apply.
1.7. Room Changes and Reallocations
After the start date of the rental contract, requests for a change of room or acceptance of a substitute tenant are subject to availability and at our discretion. The terms for changing rooms may require signing an addendum or a new contract, depending on the type and rate of the new accommodation. You will be responsible for cleaning the room in accordance with the terms of the rental contract.
1.8. Receipt of the Rental Contract
You will receive the contract and its annexes for review and acceptance through the student portal.
1.9. Booking Service
The booking service is handled by the international company Yardi Systems, Inc., whose European office is located at Vesta Building, Herikerbergweg 195, Amsterdam, NH 1101 CN, The Netherlands. This service is provided through the RentCafe technological platform, owned by Yardi, which enables transactions related to accommodation managed by the Group's companies. RentCafe enables customers to book accommodation efficiently and directly through the website www.canvas-student.es. In addition, RentCafe is the provider of the evolving email service associated with the booking process and is responsible for the maintenance of the booking engine.
